US Supreme Court Rules in United States v. Skrmetti: States Can Ban Medical Procedures Intended to Disguise the Sex of a Minor

In an internationally anticipated decision, the United States Supreme Court ruled today that States can ban medical procedures aimed at disguising the sex of minors. 

WDI USA had filed an amicus curiae brief that argued (1) that “transgender” cannot be protected legally because it has no coherent meaning, is not immutable, and does not describe a politically powerless group; (2) that children have a right to grow into adulthood and to be protected from the harms that result from blocking puberty, administering opposite-sex hormones, and/or performing surgeries to disguise sex; and (3) that sex is grounded in material reality, whereas “gender” is regressive sexist stereotypes.

Elizabeth Chesak, president of WDI USA, says: “I am happy that States can now ban medical procedures aimed at disguising the sex of minors. Article 9 of the Declaration on Women’s Sex-Based Rights reaffirms the need for the protection of the rights of the child, including the right to grow up free from harmful medical interventions such as so-called “puberty blockers,” cross-sex hormones, and surgeries. As coordinator of the WDI USA Desisted & Detransitioned Women’s Caucus, I am in contact with many women who now deeply regret the medical interventions they underwent and wish someone had protected them as children. Today’s ruling is a step toward ensuring that children grow up free from these harmful procedures. This ruling represents a solid step toward protecting the rights of the child.”

“This is an important decision that was decided narrowly,” said Kara Dansky, counsel on WDI USA’s amicus brief. “The majority reasoned that the Tennessee law in question is not subject to heightened scrutiny under the Equal Protection Clause of the Constitution’s Fourteenth Amendment because the only classifications it makes are on the basis of age and medical use; and that these classifications are not ‘suspect classes’ like race or national origin that would trigger heightened scrutiny. While I had hoped the Court would rule on the reality of sex, the unreality of ‘gender identity,’ and the rights of children, I am pleased that some 20 states have now been given the right to ban child mutilation done in service to ‘gender identity.’” 

While WDI USA is pleased that the Supreme Court has ruled in favor of the right of a state to ban these devastating medical procedures, there is much more work to be done. This includes banning men from women’s prisons, sports, bathrooms and similar public facilities, hospital wards, and more. WDI USA will continue to lead the struggle for the sex-based rights of women and girls in every arena.
