Three Thousand Medical Professionals in the United States Sue Biden Administration Over Mandate to Provide Medically Harmful Interventions Against Their Own Ethical Objections
WASHINGTON, D.C. 8/30/2021 – The Women’s Human Rights Campaign (WHRC) is pleased to note the filing of a lawsuit in the U.S. District Court for the Eastern District of Tennessee by several medical provider groups and individuals. The filing was made on August 26, 2021. The suit alleges that the Biden Administration’s mandate that the Department of Health and Human Services redefine sex to include “gender identity” (the gender identity mandate) violates their medical, ethical, free speech, and religious rights, and that it violates U.S. regulatory law. The medical professionals are represented by lawyers at the Alliance Defending Freedom (ADF).
According to the Complaint, the Administration’s gender identity mandate imposes “tangible, concrete harm” on the medical professional plaintiffs by requiring them to engage in a set of “objectionable practices” that includes “performing or participating in any combination of … mutilating cosmetic procedures to place a patient somewhere along the socially constructed gender identity spectrum.” It asks the court to declare that the Administration’s actions violate federal law and the U.S. Constitution, to enjoin enforcement of those actions, and to award monetary relief.“We are pleased to note this development in the global fight to protect women’s sex-based rights,” said Kara Dansky, President of the U.S. chapter of the Women’s Human Rights Campaign (WHRC USA). “This lawsuit is fundamentally about medical standards, ethics, clinical judgment, and the right of medical professionals to avoid language that they know to be false. Medical professionals should not be legally required to engage in unethical practices that are medically unnecessary, that exist simply to reinforce an individual’s personal identity, and that further reinforce sex-role stereotypes that harm women and girls.”
“The global Declaration on Women’s Sex Based Rights notes that the use of the language of ‘gender’ rather than sex has enabled the development of a concept of ‘gender identity’ in which sex stereotypes are seen as innate and essential, which in turn has formed the basis of an erosion of the gains in women’s and girls’ human rights,” said Jo Brew, coordinator of the WHRC. “This very positive development appears to be grounded in a clear understanding of the importance of preserving the categories male and female for medical purposes. We are coming from a feminist perspective which supports gender non-conformity as a means to overthrow sex-role stereotypes, not institutionalise them.”
