“The South Dakota Department of Corrections (DOC) states that there are currently no males according to the inmates biological sex being held in the Women’s Prisons. The response letter also states that the DOC policy on Management of Gender Dysphoria updated as of June 1, 2021, is considered non- public. And further states that the department may prescribe departmental policies and procedures for the management of its institutions and agencies, including inmate disciplinary matters and public safety, which consists of all matters relating to individual inmate behavior and to all matters relating to the maintenance of order, control, and safety within any institution under the supervision of the Department of Corrections; therefore, the record is exempt from disclosure pursuant to the FOIA laws.”
