Across the country and around the world, “gender identity” advocates have enacted laws and policies to allow boys and men to compete in the girls’ and women’s categories of many sports—and to shower and change in our locker rooms. 

They claim that this is “justice,” “kindness,” or “inclusion.”  

We ask: What about her? What about justice for, kindness toward, and inclusion of women and girls?

Fact: Women fought hard for our own sporting opportunities and private spaces. It wasn’t until 1972 that the US enacted Title IX to end discrimination in education “on the basis of sex,” but the benefits accrued rapidly: By 2006, nine times as many high school girls were enjoying the physical and mental health benefits of participating in sports. 

Women fought for single-sex sports and spaces for the express purpose of including female athletes fairly. Reverting to male-dominated mixed-sex sports excludes women and girls.

Fact: Policies Allowing Males in Women’s and Girls’ Categories and Changing Rooms are Unpopular 

Polling conducted in the state of New Mexico by SurveyUSA on behalf of WDI USA from March 24-29, 2023, showed that just 12% of all registered voters (including only 19% of Democrats and 22% of respondents who say they are lesbian, gay, bisexual, transgender, or queer) think males should be eligible to compete in women’s or girls sports “in all or almost all cases.” 

Even fewer—just 7% of all registered voters (including only 14% of LGBTQ respondents and 8% of Democrats)—think males should shower and change in open-plan women’s and girls’ locker rooms. 

Across the political spectrum, few voters support forcing girls and women to compete against —or to shower and change with—men and boys.

The Declaration on Women’s Sex-Based Rights:

Article 7 of the Declaration states:

Reaffirming women’s rights to the same opportunities as men to participate actively in sports and physical education

Article 10 (g) of the CEDAW provides that States Parties shall ensure ‘‘[t]he same Opportunities to participate actively in sports and physical education’’ for girls and women as for boys and men. This should include the provision of opportunities for girls and women to participate in sports and physical education on a single-sex basis. To ensure fairness and safety for women and girls, the entry of boys and men who claim to have female ‘gender identities’ into teams, competitions, facilities, or changing rooms, inter alia, set aside for women and girls should be prohibited as a form of sex discrimination.
